Oh hey, you caught yourself. So nobody's gonna go agro on you or anything.
ROMs are not illegal. Under US law, you have the right to back up your games to protect for the case that your original game pak is destroyed. However, in order to take that right, you have to have several things.

1. Legal ownership of the physical copy of the game pak that you wish to back up.
2. Legal ownership of a piece of hardware that is capable of copying the data from the game pak for storage on another medium.
3. An agreement that you legally agreed to before you purchased the game that does not give up the right to create a single archival copy of your game pak's data as you are entitled to by law. (Nintendo's agreement in their manuals is, under current law, unlikely to be enforceable. Dell's agreement when you turn on your new laptop for the first time, on the other hand, is enforceable.)

If you have the above three things, US law gives you the right to create an archival copy, such as a ROM image, of the software that you have purchased. If you ever sell the game pak, you must immediately destroy the archival copy. You may not sell the archival copy. You may not make copies of the archival copy nor make multiple archival copies. You may not lend archival copies and still use the original game pak.

It's a bunch of loops and hurdles to jump through and over, but it isn't illegal as long as you jump through said loops and hurdles

Unfortunately, because of how most people do obtain ROM images through illicit means, this has led to many people just calling ROM images illegal. This is untrue. However, unless the ROM images are obtained in the method stated above or via legal permission of the company and/or persons legally representing a game, they are most likely illegal.

It's a thin line, but it's a frightfully clear one. @.@

And like I said in that topic, IIRC, Nintendo made it illegal to actually use those copying devices anyway, so for Nintendo stuff anyway, it's not even legal to use the device to make your own backup to begin with.

So go Sony and my backed up imports.
But that's by the terms of the manual which can be argued quite easily to not be legally binding for a myriad of reasons.

1. Not able to be read before the purchase.
2. Not read by "anybody", which actually was a reason for why a recent case regarding the terms of use on a website were not considered to be legally binding (as it did not require any sort of indication of agreement other than usage of the site.)
3. Not agreed to by the exchange of money, credit, or other funds which provide the sealing of the terms of the agreement for which you purchased the software. Couple it with the first one and you've got a great argument.

As for the legality of the actual backup devices, that's something that I don't really care to touch except to say that a piece of post-DMCA legislation that passed last year that gave the right to archive video games that were for systems that were no longer actively produced. In the time between that legislation and the DMCA's passing... there may have been argument. For now, however, there is not enough to make it worthwhile.

Additionally, I should herein note that it was not the DMCA which gave the right to make one archival copy of software, but something far earlier. The name escapes me. I believe it was in the 1970s or 1980s, however. I'll ask the record producer I know; he knows it. ;)

At any rate, though, even though the vast majority of ROM images on computers out there are from an illegal source, this does not make ROM images themselves illegal. If you're going to call ROM images illegal, you need to put an "unless" in there.

"ROM images are illegal unless you created it yourself as an archival image."

"ROM images are legal if created properly, but are illegal to distribute without the proper legal permissions."

Your choice, but to say it either way doesn't tell quite the whole story. To call them illegal it an outright lie, one that even Nintendo has begun to turn away from.

A more recent bit of PR, however, uses altered terminology.

The emulator promotes the play of illegal ROMs , NOT
authentic games. Nintendo Emulators promote piracy.... It's that simple and not
open to debate.

And, for that matter, the same time as the emulator quote from the website above had this to say about ROMs.

copied from an authentic Nintendo video game cartridge.

You'll note that they avoid using the term "illegal" in there. ;)

At any rate, if I don't stop this post soon, I'll really get into a rant.

To summarize: ROMs aren't intrinsically illegal.
1. ROMs are legal to make of carts you own if you make the archival ROM image yourself.
2. ROMs may not be distributed unless you have legal permission from the creators/right-owners to the software.

Because ROMs aren't intrinsically illegal, it is a lie to say that they are without putting a proviso on to note the cases stating where they are not.

And, of course, that's why I write this. When someone calls ROMs illegal, it angers me. It angers me because it is a lie. It is misinformation. Provisos could be attached, but they aren't, and that's what makes it such a lie. Because Yoshi348 and GreenMamba put forth misinformed untruths, I feel yucky unless I put forth informed truths wherever I am able.

Oh dear. I wrote this for so long that I forgot to mention this. Red Scarlet, I really do love that Necrosaro avatar you have. I still rate DW4 as one of the best RPGs ever made and the final (seven stage) boss battle only second to FF3/6's. I just wish that the translation plans hadn't been cancelled for the game. It would have been the last console game that I bought new. :/

Translation, smanslation.  If you remember the game decently, it isn't that uber hard to play through, IMO, and I found it to be worth going through anyway (actually I just went through it and finished earlier tonight again).

Oh, I'm sure I could play it just fine. It's just that I'd like to see a more liberal translation done of it done without all the Nintendo censorship.

I might pick it up sometime or tell my friend that is always finding fun imports to try to get it for me, but then I'll have to find a PS1 that actually works or really shell out the money and get a PS2. My little brother had his fun with our shared PS1. It doesn't play very well anymore... and is a quarter day's commute there and back, plus stopping time.

It's sad that *more* people don't recognize Necrosaro. Considering the era, if they had actually remade the game as the DW7 manual advertised (full 3D), then it would have been amazing. As is, I wish I had the time to rip/capture it. The 3D->Sprite animation depicted in your avatar at least does justice to how it felt to fight that final battle back on the NES way-back-when.

As for my cart collection, there's around 150 NES games just in storage... quite a few more at my home... and all of the manuals here at the dorm. After all, I need something to scan and thus preserve during my spare time.

That said, it's time for some water and then sleep. Need to get up around 8:30 AM in order to get in breakfast before classes start... and without my roommate's TV waking me up (thanks to his alarm on it), I will need to spend energy to wake. ^^

The remake of 5 was a little more 3-Dish I guess (I'm not that great at differentiating what D stuff is if it's not 2-D), and it played really fast; it was a good remake I thought.

Then again I like all 5 of the remakes anyway.

Yeah, most people I talk to are like DW? Dynasty Warriors? And makes me go  :? .

Oh well, if you do actually decide to try to give the game a whirl, I'd help you out if you want (finding it or playing through).

Ok, so Crocomire's Data is somewhat in ZM, so what?  There's no real way to fight him unless you hack your rom.  After recently playing Super Metroid, I found crocomire.... interesting.  Sure enough though, he was kinda cool.

Anyways, Crocomire wasn't in teh original Metroid, was he? So, why did nintendo Kinda decide to put him in there, and then take him out again?
