Doesn't matter, though I'm sure it's the first one. Either way, it IS his avatar, so you would have to ask him before using it, no matter what Dark_SA-X thinks. Just because he didn't actually draw it doesn't mean it's not his creation. It's the same idea as people who use stocks of Link in their sigs - they didn't actually DRAW Link, but they used him.

What if you write the credit in your signature?

Personally, I wouldn't mind if someone used my images as their avatars as long as I got proper credit.
